The publication is a comparison of the decision-making practices of the Czech Industrial Property Office and the European Union Intellectual Property Office. The publication is a brief guide for applicants who are interested in the decision-making process of both offices by providing specific examples from both institutions. The applicant should be able to get a closer look at the whole procedure, from filing to the registration of the trade mark and help them familiarise themselves in this certain area.
Countless numbers of books about trademarks, legal protection of industrial and intellectual property have been written, materials on the Trademark Act, obtaining protection at national and international level, and the acquisition of distinctive characters are also common. .
The presented book is trying to briefly explain concrete issues of obtaining trademark protection at both the national and EU level, specifically in regards to lack of distinctiveness, or when the trademark application could be found against public morality – which is a subject that has not been extensively written about.
Given the fact that the trademark itself provides the owner with an unlimited period of protection, it is appropriate for the trademark applicant to pay attention to every single above mentioned aspect of trademark protection.
At the same time, the publication is intended for students dealing with intellectual property issues, the public and last but not least, for enthusiasts. Since the publication is not meant for specialists in the field, it is written in a light, easy to understand and accessible style, often humorous.
The publication contains an explanation of distinctive characters, lack of distinctiveness, convergence programs, trade marks considered against the public order or morality and certification trade marks.
Each of the mentioned trademark applications or trademarks is also commented by the authors who provide their own opinion.
